 . Background

Online trading effectively eliminates the geographical barriers and allows for businesses Advertise, market and sell products and services in new ways. These new ways Cause business entities set up their businesses in order to reduce or eliminate the barriers Mainly economic tax barriers . The Internet poses many companies easy option Relative to conduct their business activities in different countries according to business functions . Way, For example , a company can produce in one place and build marketing sites elsewhere, or Although virtually , without any connection to the country where the company is registered with loose crunches In the rules of business operations practices. This means , the business must be Has a fixed place of business to transfer goods or services via the Internet Customers. Trading through the Internet has multiple benefits such as simplicity , since transactions Generally do not require the employment of intermediaries such as brokers , banks and institutions Other financial information that facilitates greater price comparisons , access to consumers Many at the same time in different locations, and more. Due to these advantages , the volume of trade Internet in recent years very rapidly and is expected to grow further in the future . [ Nearest [ 1 In this article we will mainly under the influence of online trading VAT . VAT is The main indirect tax that requires attention due to internet commerce. Indirect taxes Others , such as customs and purchase tax , currently do not generate tax questions resulting Internet commerce . Relating to Customs , declared by the World Trade Organization that trading Internet is duty- free trade area in terms of transactions in an Concrete [ 2 ] . Regarding sales tax , the question of taxation does not arise at all , since no . [ This applies to a closed list of products that do not include intangible products [ 3 Generally, about tangible goods acquired through the booking is done through the Internet tax collection are not essentially different from the collection of those taxes when The transaction is done in the usual way , as will be discussed later in this article . The question of taxation of Internet trading is not easy and raises a number of fundamental issues . Application of existing tax practices or finding new methods of taxation transactions tax Internet should be examined with attention that the lack of tax base equal to the sale Goods or services are identical , with the only reason for this is method of trading Which will cause damage to the principle of equality and bring unfair competition between dealers Different . This injury is contrary to the principles at the basis of the VAT Act , And the main principle of which – the imposition of VAT on a broad basis and at a uniform rate so that Caused by the product or service preference one over the other for tax reasons . Therefore be sought A solution which avoids possible distortions and creating a comparative advantage by trading through Internet versus trading in other ways. Online trading system up and actually The question of whether to continue to apply the techniques currently practiced tax on trading Online?  Internet – working method To meet the problems resulting from trade taxation issues online has to understand . [ How the Internet Works [ 4 The Internet is actually a transfer of information in the form of text, images and music From one computer to another in a certain way . This method is by binary codes After being transferred from one computer and decrypted by the software called browsers , such as : . MICROSOFT EXPLORER or Netscape NEVIGATOR This means that the business did not have to have a fixed place of business to transfer Information to the customer. When the client knows which product he wants and where to address Of the business, ie , the URL , it must enter this address in the browser found on the computer His personal and comes to the site. This process of Internet link between the wishes of the customer And the site where he wants done through ISP , such as Netvision or Internet Gold , by a communication line such as , for example, a phone line. Request of the consumer, who knocks The URL where it wants , delivered to the consumer via the Internet provider Its the server that stored information in the site requested. After receiving the The request returned an answer from the site to the applicant through the computer . The final result Is that the consumer gets the content of the website on the screen of his personal computer . The main tax issues that arise as a result of Online trading Trading can be divided into two main types online . One is the use Internet for purchasing / ordering goods or intangible services (as software Computer , books , etc. ) . In this case, the Internet is only used as a tool To order the product , and the product itself is sent by mail or by courier. The second type pure ” Internet commerce is making the product ( an intangible asset ) Or service through the Internet . Making such trade can only exist Digital products ( software , data, video , etc.) or services . In fact it is Transaction carried out through the Internet , if a sale The distinction between tangible products intangible products has materialized mainly regarding Determining the place of the transaction. While all taxation for tangible products is territorial , The rule regarding intangible assets is recognized according to the residency of the product , as Section 14 of the VAT . [5] When it comes to the type of ” trade ” first (products Assets ) does not have any problem , since existing tax principles remain the same When a reservation is made through the Internet . Thus , with regard to the import and export of Tangible products the ones that go in the ports of the country. Exports of goods requires removal Export entries and the transaction must , by law, zero tax rate . Importation of goods , the importer Taxes are charged on the basis of the import entry number is generated for the discharge [ Customs. [ 6 Therefore, we focus on and we will review in this article the issues that arise in trading in products an Assets through the Internet , especially the import and export of goods and services Those who do not pass ” physical” ports and which stimulate a number of issues Principle. Below we review these issues : The first is determining the type of transaction in question . Is it comes to purchasing a product or Giving service . Sale or provision of services have different tax implications . Like – yes and no Determining the type of transaction is not possible to determine the place of the deal . The main reason why Is a different definition regarding the place of the transaction between “sold ” as stated in Article 14 of the VAT [ 7 ] , and the ” provision of services ” under section 15 ( a) of the VAT [ 8 ] . This is because The main problems in online trading , trading concerns intangible assets . While Addictive, Section 14 defines all local inhabitants deal, section 15 (a ) deals . [ Identity of the service provider , the identity of the service recipient and the matter in respect of which [ 9 Second , after determining the type of transaction , is determining the place of the transaction. This determination Lead us to the conclusion that a competent authority to impose a tax on transactions, whether the Cases of import or export or trade in the country and who is liable to tax . Third is the problem of enforcement . Even if we overcome the first two problems in terms of Identify the type of transaction and the origin of the transaction in principle , there is still the problem of achieving Factual information . For example, online trading makes it difficult for parties detection Transaction. Accordingly, even if the tax authorities solve the above problems practical difficulty arises Tax the transaction. We will discuss these issues in detail according to the order above. A. Determining the type of transaction Important distinction between “sold ” Matan Service “for the purposes of VAT Act is mainly due The different law regarding selling versus servicing a number of factors including: a place Transaction tax billing date , VAT of “zero” and more. Problem of the distinction between giving Service acquaintance increases when it comes to making deals intangible products Internet. For example, the customer magazine publishes his articles on the Internet , There may be foreign residents . In this case, for a subscription fee , you can read Articles on the computer screen , download articles from the articles , and more. Lending Arises is what type of transaction resulting from the sale of subscription version online? On the one hand , we see providing a database and giving the user options to select the The desired information , mode of providing service . On the other hand , the very ability of the user to download Information they wanted to build himself a private newspaper that if he had sold it As real as a newspaper or on a floppy disk was considered as a product for everything, leading to the conclusion That transaction for the sale of a product. For example , you can visualize the foregoing, in the event of an Israeli company that provides Data online stock trading in Israel. If we say that the product an Tangible sold to a nonresident , the zero rate will apply it according to the provisions of section 10 ] VAT Law . Conversely, if it comes to providing a service , then you may apply ] ( 30 ( a) ( 2 Exception to the provisions of section 12 (a) [ 11 ] Tax Regulations ” zero rate limitation due Services ” , and the service provider will undertake VAT. We note that with respect to computer programs sold via the Internet, the proper tax authority American regulations that discuss the classification of the transaction [ 12 ] . Under these Regulations must ask what Involved in the transaction ? If it is , for example, the transfer of copyright, or transfer a copy of Software is protected by copyright , then probably have to see it sold . However, if it is a case of providing services for developing or improving computer software Or Knowledge of programming methods , then this should be considered a service. Cases are difficult and borderline when it comes to online trading and conclusions are Always clear . But it may be said that where the provision of service is not dominant or Essential in the transaction but is incidental to the sale of goods , then will not see that deal Provision of services but an integral part sale transaction . In . Determine the place of transaction Determining the source of income interest income tax, and this is very important because the resolution of At this point answers the question – which country will be entitled to collect the tax when you make International transactions . Most international tax treaties ( relating to income tax ) Define the country of origin as who is entitled to collect the tax and the State Residency prevented completely or partially from taxes on income , whether through granting of an exemption , And if by giving credit or deduction for tax paid by the taxpayer , the country of origin . State source of income is in most cases the state in which economic activity occurs It derives income . Regarding VAT can be said that the question is whether you can See their place of transaction in Israel as defined in section 14 of the interest sold , and section 15 ( a) ( 1 ) of the Act regarding the provision of services ? Answer this question implications on several levels . We emphasize that online trading makes it difficult for application tests currently available for determining Place deal regarding VAT ( so the purpose of determining the source country tax interest income ) , For most cases this type of trading geographic origin clearly defined . That is, can Sell products and provide services via the Internet without having to set up an infrastructure Territory which has been used up to now . Later in this article we will refer to these problems are Regarding the sale of assets and with regard to the provision of services . In . One . Determining the place of the transaction for the sale of intangible assets Israeli law stipulates in Article 14 regarding the sale , the property is sold in Israel : ” If the property was in Israel at the time of delivery to the buyer, or if a Israel , and an intangible asset – if the seller is a resident of Israel. ” That is, the VAT law adopts the territorial approach regarding tangible assets and Approach residency for intangible assets . As mentioned above , complex and problematic cases are cases of products an Assets acquired through the internet. Intangible Product Section 14 of that will see the property sold Israel ” if The seller is a resident of Israel. ” Although tax law is not set in section 1 of the term “Resident of Israel ” [ 13 ] , but we can learn from Article 1 This Law defines a “resident of Israel – 1 ) For an individual – an individual living in Israel and is absent but a temporary absence ); 2 ) for a member – members – Adam – ) ( A) a member – members – a person registered in Israel and most of its business or activity is in Israel; ( B) a member – members – a man whose control and management operated from Israel ; (C ) section … ” That is, the same definition to define “resident of Israel ” Income Tax Ordinance [ 14 ] and therefore . [ The tests are the same tests the IRS for resolution on the issue of residency [ 15 Online trading in products of this type raises the problem of the location of the transaction , ie Is the property sold in Israel. To set the place of the deal three immediate implications : 1 . Bone tax liability – shifting transactions through online trading can cause Non- recognition transaction transaction carried out in Israel, allegedly Shams State Israel was allowed to charge , no charge and it exploits an Internet trading Transaction is defined as ‘ not viable taxation . 2 . Reduction of the amount of the tax liability – through Internet trading can affect a place Transaction so that transactions are considered as exports , and consequently will be taxed at a zero rate , instead Maybe recognizes Israel and regular tax liability . We will show that with respect to sale of an intangible asset , . [ The current legal situation , you can not reduce the amount of tax liability [ 16 3 . Shifting the burden of payment – through Internet commerce possible to determine the place of transaction That reporting obligations and payment burden Joost from one side to the other, such as from the seller to the The buyer. 1 . Bone tax liability ( ” evading the residents” ) . In . 1 Internet opens L”hthmkot the residents ” as far as the products an Assets. This means that transactions do not enter the fence sold according to the VAT Law , and The State of Israel will not be authorized to charge tax on these transactions . In fact one can think of two ways to evade the definition of residency Israeli online trading results : The first is related to the very question of the weight to be given to the location of the web server. That is, Is a web server located in a particular country is that which defines the existence of ” Permanent establishment ” and the concept of residency [ 17 ] . Assuming important weight web server that Definition of residency and therefore defining the place of the transaction on assets an Intangible then using server location can trigger the problem of the location of the transaction. An example of this can be seen in the case of sale software from client state Israel Otherwise , by ” downloading ” the customer ‘s computer software via the Internet . Mode This , most of its operations and business , as well as management of known Israel drawn through Setting up a web server and a third country . The question is , what is the place Transaction ? Might we performed sold in Israel ? If the answer is Negative then the company will not be taxed in Israel, even though that is registered in Israel and has . [ Any business center in Israel , but there is a main business and operations [ 18 The second derives from the very possibility of trading online to cancel the term “control Management operated in Israel ” , as the definition of residency . Example of such a case is Company with multiple manufacturing locations in Israel and abroad , such as a software company that has several Programmers and every programmer sitting in another country and the end product is a single software , a product Of joint activity . In this case the question arises where the sale was made ? You can think Such a society is not encompassed by the alternatives ( a) or ( b) the definition of member – members – human concept ” Residence ” under section 1A of VAT [ 19 ] , and therefore the place where the transaction does not Clear enough . This means we may and an acquaintance committed in Israel and therefore . [ State may collect taxes for a transaction of this type [ 20 Israeli residency definition evasion can lead to two possible outcomes. First , when the sale is a resident of Israel . In this case there is an import transaction must . [ Tax , then in fact we can say that the company formerly pushed the tax burden [ 21 Second , when the sale is a foreign resident . In this case the discussion is purely theoretical problem Not bother the tax authorities , as in that case the interest of the company will show that The transaction is an export under section 30 ( a) ( 2 ) of the Law, then the rate of VAT will Reset all that entails . 2 . Reducing the tax liability . In . 1 Very definition of a place at Marathon transaction ” under section 14 of the VAT , in respect of property Intangible place of residence , it follows that there are essentially two options: either performs The transaction is a “resident of Israel ” and therefore the place where the transaction is Israel then was Taxable transaction or a transaction is not a ” resident of Israel ” and the place of the deal . [ Not Israel then there will be no tax on the transaction unless it imports to Israel [ 22 Thus essentially the same debate actually discussed in the section of the tax liability . 1 . Above , since only By evasion female residents can actually lead to a reduction of the tax liability . 3 . Shifting the tax burden . In . 1 As mentioned, the Internet facilitates trading company to move to its business wholly or Parts elsewhere. Copy this allows the company to change their business performance Such a tax imposed on it will be minimal . Even here , in fact, there are two options for copying activity which could not The mere cancellation of payment of the tax , but the sliding it . First, the very definition of the server as the business of the company. In this situation, Israeli company selling via the Internet to customers in [ 23 ] , when The server is located in a third country , may not be defined as an acquaintance Israel but will be a . [ Import , and Yost took a payment from the seller – the company, to the importer – customers [ 24 The second is a case of business cooperation between some of the details which constitute fact One company even if Registration is done in Israel. In this case the customer may be sold Israeli imports will be defined not as an acquaintance which was carried out in Israel , due to the difficulty in defining the . [ Now resident of the ” [ 25 ] . Therefore Joost deal to importing burden [ 26 The practical significance diverting tax burden is worsening enforcement problem 3 ) provides that imports of tangible goods is a taxable goods , and section ) of section 16 26 (b ) of the Act states that ” intangible goods imports … , there was a tax liability Purchase of foreign currency in a financial institution for payment for the purchase … ” . . [ Thus a mechanism of withholding tax [ 27 Importer , whether an individual or a company, importing an intangible asset through The Internet is not likely to pay him no , since the payment would not necessarily Using a “financial institution ” and therefore any withholding tax will not be deducted for this activity . Indeed It can be said that this problem existed even before the existence of internet trading , but No doubt that is exacerbated when it comes to online trading where you can download the Intangible product on the computer , while in other cases the product obtained was Is usually obtained through the postal service . In . 2 . Determining the place of the transaction for the provision of services In the case of service provision , section 15 of the VAT that Israel can service number Cases [ 28 ] : The service is provided by those who dealt with Israel or it can be an Israeli resident Or it can be for assets located in Israel. But even this broad section does not solve the The problem of the place of the deal when making trading online. In the case of the provision of services arise the problems of the location of the transaction as a result of Online trading , as mentioned above in the discussion regarding the sale of intangible assets . However, due to differences in the definition of place of the deal between the sale of an intangible asset in accordance Section 14 , which is defined as stated according to the principle of residence , compared to the place where the transaction Providing service as provided in Section 15 (a ) of the Law may be changes in analyzing issues related to Place of the transaction. Discussed issues per sorter , as discussed regarding sale of property Intangible assets , and emphasize the differences arising from the difference in the definition of performance Transaction. 1. Bone tax liability . In . 2 Dodge classifying transactions anywhere their implementation is in Israel , ie , exit Gender Section 15 (a ) of the Act , is also possible in two cases , as noted in the discussion above of an asset sold Palpable. So by the possibility to get out of the term ” engaged in Israel,” the provisions of section 15 ( a) ( 1 ) of the Act . One alternative regarding Section 15 ( a) of the Law, ” who dealt with Israel ” is determined by making Transactions regularly and continuously [ 29 ] . However, online trading can cancel the Continuity and interrupt the continuity . For example , a software company with a certain affinity Israel and which services are providing a solution to a particular program can do it By a number of programmers with each sitting somewhere else and everyone working on a solution Problem. In this case there is no doubt that it is providing a service, but it is doubtful whether it . [ In the case of ” who dealt with Israel ” [ 30 2 . Reducing the tax liability . In . 2 Through online trading can affect the place of the transaction so that transactions will be considered Exports, and as a result will be taxed at a zero rate , instead of maybe providing services in the country and Liability Normal tax . While intangible asset sold tax burden reduction is possible only on the Theoretical [ 31 ] , the situation is different in regard to service delivery. Providing service becomes the problem Feasible due to the taxation rules set forth in Section 15 (a) of , and paragraph 30 (a ) of the Act – Subsections relating to export services. Simple case that illustrates the problem is , for example, the state of service delivery solution Software problems by an Israeli client state of another service . It is given by ” Downloading ” software ” corrects ” the client’s computer over the Internet. Lending What is the place of the deal ? Answer this question bearing on the rate of Liability Tax of the company. In case the seller is a company ” who dealt with Israel,” If it is a case of Export to a foreign resident , then we enter the fence section 30 (a ) ( 5 ) ” providing service to a foreign … ” And can apply zero tax rate . In contrast , the situation in which we define the provided service Israeli resident ” in Consequently, the server is in Israel , then the transaction will be liable for VAT as other transaction . Ie in this case the location of the transaction affects the rate of the tax liability of Society. This problem is more acute in light of the various restrictions found in Section 30 (a ) of the Act and related Export services. For example , a company can reduce its tax burden is to commit the By determining the location of the transaction differs for providing services through the Internet. Example This is an Israeli company that provides service to customers in France through a server Internet in France . Where does the question arises for service delivery Charging VAT ? Could it be that the service abroad ( France ) due to the location of the server ( Then applies a zero rate under section 30 ( a) ( 7 ) of the Act or whether section 30 ( a) ( 5 Then apply the exceptions enumerated his body section and Section 12 (a) ? 3 . Shifting the tax burden . In . 2 As mentioned above, copying the Company’s operations through the server location allows the company to change The place where the business in such a way that the tax imposed on it will be minimal . Problematic This also exists in the case of imports of services from abroad. Discussion In its essence , mutatis Required [ 32], discussed in section b. 3.1 which appeared above , regarding the sale of an asset Palpable. The amount of the issue regarding the place of transaction VAT In conclusion, the very possibility of the client – using an online download products Tangible personal thoughts create the problem of space deal. Issues of definition Place the transaction becomes difficult when we assume that the Web server weight in determining Place of transaction [ 33 ] . But not only the location of the server affects the creation of difficulties Defining the place of the deal . Even the very possibility of splitting its geographical location Company using the Internet causes problems of defining the place of the transaction. In our opinion , there Room for discussion on whether there is weight to the location of the web server for determining Place deal. In general, one has to ask whether the server is in a particular country can Be considered as a transaction , so that state may impose a tax on business activity Activities associated with the server ? C . The issue of enforcement Even if we overcome the first and second issues : identifying the type of transaction and the place where the Transaction , in principle, that we have a clear understanding if the tax laws of the country Apply to a particular transaction will still have the problem of obtaining information in respect Factual . An example regarding the VAT is the existence of a real difficulty in monitoring imports Intangible products that the user be downloaded for personal computer . One Possible difficulties in importing intangible assets is the very possibility of evasion Solvent [ 34 ] . Under Section 26 ( b) of the ” intangible goods imports … applies taxation With the purchase of foreign currency at a financial institution for payment for the purchase … ” . Therefore there The mechanism of withholding tax. Importer , whether an individual or a company, importing An intangible asset over the Internet is not likely to pay for it will not be deducted for tax Withholding tax on this activity. While it can be said that this problem existed before The existence of internet trading , but no doubt that is exacerbated when it comes to trading Internet where you can download the intangible product on the computer, in cases Other product obtained was usually obtained through the postal service . This example raises a number of problems : no ability to identify the parties to the transaction and place Transaction , since knowledge depends on a reliable report of the importer . Like – well , no use Intermediate mediator ( financial institution , in the example above) which will help tax authorities to identify The transaction by reporting the very transaction. In addition , there is no capacity to monitor the measures Payment , if payment is digital , used dealers online. In light of the above example , we notice the existence of a number of problems arise concerning the ability [ Enforcement of the tax authorities. Below dominance that [ 35 C . 1 . The problem of identifying the parties to the transaction Anyone can now open a Web site at relatively low cost and registration provided Minimal. This site allows the body to the site owner to display his wares and mine all Who wants it . No trader must show his true identity , but he can use False identity . The buyer, who wishes the merchant’s wares , encounter real difficulty to locate the True identity of the trader . The identification problem is not limited only to identify the parties to the transaction , but also to identify a place Transaction . As stages mentioned above in the discussion on the issue in the second , due to the nature of the Internet Which does not recognize the existence of geographical boundaries , the problem of identifying a place transaction is Difficult and can be affected by the construction sites in which they Tax advantages . C . 2 . E- money problem Internet payment method of particular importance to commercial success Internet as a method of trading comfortable and safe . Therefore, efforts are being made to develop methods Payment over the Internet to meet the needs of the online trading system [ 36 ] . One of the These methods is electronic money . The idea behind this method is the development Payment is based on the basis of anonymity property cash, ie , lack of The ability to associate a money factor . Obviously, the success of the use of money to Email banks allow their customers must use electronic money order Purchase of goods and services. Payment may result difficult problem of enforcement, In view of the fact that today the tax authorities can inspect and verify invoices by Examination of the movement of goods , bank accounts and more. Overcome the problem especially if there is no All track the use of electronic money , as opposed to the current situation there is a partial inspection The use of credit cards . Though one may think that the issue is similar to normal trade for money which was until now The biggest problem in tax evasion . However, regular use of money is not convenient And safe when it comes to large sums . While electronic money similar characteristics Regular money , but money is better than normal thanks to the ease and relative safety in which May be transferred from place to place around the world. C . 3 . The problem of lack of Realtors Many transactions , national and especially international , are usually carried out using Intermediaries, such as lawyers , accountants, banking and more. In many These intermediaries are obliged countries reporting to the tax authorities . In this emergent points Audit for the tax authorities , since they receive them data which they can Cross with additional information which comes from the taxpayers . Authorities that have the ability to monitor More effectively on the taxpayers . Using the Internet creates a primarily direct contact between the customer means a trader . In this situation , the use of intermediaries almost disappeared . Following the decline in the use of factors These also decreases the ability of tax authorities to use these bodies to receive Information on taxpayers .  Amount In this work we tried to briefly review the various problems in terms of the VAT Act Arise as a result of trading online. Material showed that can be caused Difficulties in certain situations when we tax the activity carried out online Under the VAT , because of the difficulties mentioned in the definition of the terms ” nature of the transaction ” And “micom deal. ” Practically enforceability of the tax authorities , including VAT Is limited. In this regard we have demonstrated , among other things, the ability to shift the burden of payment VAT on the one hand to the other when a transaction is made via the Internet. However , in our view , the fundamental question we need to address it first, it is the policy Department ‘s overall VAT Is there any place to tax the trade in products an Intangible online? When we give an answer to these questions , one must take into account on the one hand the harm resulting As a result of online transactions tax , a significant injury in the light of VAT and, on the fact that close supervision of Internet commerce and making it difficult Online transactions can harm the process of globalization and the opening of new markets , That the economic damage will be greater than the benefits to the Participants as a result of taxation of transactions Internet. 1.
